While many people are aware of the dangers of drinking while driving, some do not realize that fatigued driving can be fatal. Much like alcohol, fatigue delays reaction time, decreases awareness, impairs judgment, and increases the risk of a collision. The Federal Motor Carrier Safety Administration (FMCSA) enforces federal regulations in the trucking industry. The FMCSA has long recognized the epidemic of fatigued driving and all of the dangers that it entails.
Historically, truckers and trucking companies have a habit of pushing the limit and violating the FMCSA’s HOS regulations. To strike back, the FMCSA is imposing maximum penalties against trucking companies and drivers who commit egregious violations.
If you were injured in a trucking accident because of a fatigued truck driver, contact Kooi to schedule a free consultation with one of our Indiana drowsy driving truck accident attorneys. We have intimate knowledge of truck accidents and are equipped to investigate the most complex of cases!
Federal Hours of Service Regulations
According to U.S. Transportation Secretary Ray LaHood, “Safety is our highest priority.” In a press released published by the FMCSA, it states that working long daily and weekly hours on a continuous basis is associated with chronic fatigue and a high risk of crashes.
The FMCSA recently revised its hours of service (HOS) regulations, the new HOS rule for property-carrying drivers is as follows:
- Limits maximum work week to 70 hours.
- Truck drivers who reach 70 hours may resume if they rest for 34 consecutive hours.
- Truck drivers must take a 30-minute rest break during first eight hour shift.
- The final rule retains the current 11-hour daily driving limit and 14-hour work day.
