Defective Products

Corporate America makes a lot of money through the sale of products, which we, as the consumer trust are reasonably fit to serve the purpose for which we purchased the product. When a product fails to serve the purpose for which it was sold, and causes harm or injury to consumers, the law may allow for compensation for that injury or harm.

A defective product is an unreasonably dangerous product that causes a person injury or harm as a result of a defective design, manufacturing or faulty labeling. According to the U.S. Consumer Product Safety Commission (CPSC), there are approximately 22,000 deaths and more than 29 million injuries associated with consumer products each year. Examples of products recently defined as defective include industrial machines, breast implants, children's products (toys, car seats, strollers, etc.), faulty brakes, hip and joint replacements, tobacco smoke, tires, airbags, and prescription drugs. Virtually any product in the home or workplace has the potential to be a defective product. This does not, however, render any and all accidents associated with that product grounds for a suit. For instance, though cutting yourself with a knife while using it in a normal fashion is not grounds for a suit, if you cut yourself when the knife broke because of a defect in its design, you would then have reason to file suit.
